Acknowledgements and Jurats are the two most common notarial certificates.
JURAT- is used when the signer is swearing to the content of the document. The notary must administer an oath or affirmation to the signer in order to complete the jurat. A jurat also requires that the signer signs in the presence of the notary. It is possible to glean this information from the jurat certificate its self. The wording states “Subscribed and sworn to before me…” – subscribed meaning “signed” and sworn meaning that an oral oath or affirmation was given. “Before me” means that both were done in the presence of the notary public.
ACKNOWLEDGEMENT- is used to verify the identity of the signer and to confirm that they signed the document. They are not swearing to the truthfulness or validity of the document, they are simply acknowledging that they signed the document.
Please Note: A notary is legally prohibited from telling a signer what certificate they should get. When you contact me please let me know what you need. I am looking forwarding to serving you.
- A clients (signers) must sign a journal for recording purposes.
What is a notarial certificate?
A notarial certificate is required for legal documents that require notarization. It provides proof that the notary witnessed the signing and confirms the identity of the signer.
PLEASE NOTE: The client must advise which certificate is to be attached. A notary cannot choose which certificate should be attached. If you, as the signer are unsure, you should contact the individual or agency that issued the document.
This helps to prevent fraud and provides a level of assurance regarding the validity of the document. Notarial certificates are commonly used for various legal transactions, including deeds, contracts, powers of attorney, affidavits, and other important documents.
What if my document is missing a notarial certificate?
When certificate wording is not pre-printed on the document, it is upon the signer to select the type of notarial wording (Acknowledgment or Jurat). Notaries can neither choose nor advise in this matter. If uncertain what type of notarial certificate is needed, please contact the author of the document or recipient, and have them advise you regarding the requirements..
What is an Acknowledgement?
An Acknowledgement is used to verify the identity of the signer and to confirm that they signed the document willingly. The signer must appear in person at the time of notarization to be positively identified.
What is a Jurat?
A jurat is used when the signer is swearing to the content of the document being true. The notary must administer an oath or affirmation to the signer in order to complete the jurat. A jurat also requires that the signer signs in the presence of the notary.
